1. Goal

This document establishes the pre-contractual information relating to contracts concluded remotely on the website www.ciano.pt, referred to in article 4 of Decree-Law no. 24/2014 of 14 February, and all subdomains/sub-websites.

The domain www.ciano.pt is the property of CIANO Aquarium, S.A., with a registered office at Rua de Revinhade, nº1055, 4650-376 Revinhade, Felgueiras, with telephone number +351 255 340 450 (Call to Portugal’s fixed network) and e-mail info@ciano.pt, legal person no. 501828699, registered with the respective Commercial Registry Office under the same legal person identification number, with a share capital of €1 000 150.00, hereinafter referred to as CIANO Aquarium.

CIANO Aquarium reserves the right to freely modify this pre-contractual information in order to adapt it to the applicable legislation, without the need for any prior notice.

Browsing the www.ciano.pt website, its subdomains, and sub-websites, as well as purchasing any product from those addresses, presupposes acceptance of this information and the General Conditions of Use on this page.

2. Conditions of use of www.ciano.pt 

The use of www.ciano.pt must be carried out by people aged 18 (eighteen) or over, and people under this age must have the authorization of their legal representatives.

Users of www.ciano.pt must act/buy as end consumers, i.e., outside the scope of any business or profession. If you are not a “final consumer”, please do not make any purchases on www.ciano.pt.

The User undertakes to use this website in compliance with the provisions of the applicable legislation, refraining from using the website for activities contrary to the law, morality, and good customs, or the rights and interests of third parties.

CIANO Aquarium reserves the right not to process orders registered on the www.ciano.pt website when there are doubts about the User’s status as a final consumer or when the orders do not comply with the general conditions of sale presented here.

These general terms and conditions of sale exclusively regulate the offer, acceptance of orders, transmission and shipments made via the www.ciano.pt website.

The buyer must provide CIANO Aquarium with a correct and complete e-mail address, postal address or other contact details, and accepts that the seller may contact him using these details if necessary.

The User is obliged to update the information provided to CIANO Aquarium whenever it changes.

Users are expressly responsible for any false or inaccurate statements they make and for any damage they cause to CIANO Aquarium or third parties with the information they provide.

3. Amendment to these Conditions

CIANO Aquarium reserves the right to unilaterally modify, at any time and without prior notice, the presentation and content of the website, its services and the general conditions of use, with the exception of contracts already signed and in progress.

These modifications will serve to improve the website, while at the same time improving the services offered to the User of the website.

3.1 Right not to accept the order or to cancel the purchase

CIANO Aquarium reserves the right to cancel any order, even if it has already been confirmed, in the following situations, without being liable for any damages or costs:

  • The product is no longer available (payments will be refunded);
  • Billing information is not correct or verifiable;
  • The order being flagged by our Security Systems as an incorrect order or an order susceptible to fraud;
  • Payment is not received within 5 calendar days of acceptance of the order;
  • If there is evidence that the buyer is under the age of 18 or does not have authorization from their legal representatives;
  • If there are indications that the buyer is not a final consumer;
  • If detectable that the price indicated in the Online Shop is wrong;
  • If the parcel cannot be delivered to the respective address;
  • If the purchase is made from one of the countries that are not on the list of countries to be selected for delivery purposes.

4. Intellectual property

All the content and information on www.ciano.pt and its subdomains is the property of CIANO Aquarium and therefore the use, reproduction, copying and dissemination by other means of logos, texts, images and videos on that website is subject to its prior authorization.

5. Product and Pricing Information

5.1 Price Information

Prices quoted should be understood in euros. Including taxes (VAT) at the legal rate applied in Portugal.

Without prejudice to the above, the applicable tax (VAT) may vary according to the country of the purchaser.

CIANO Aquarium reserves the right to change prices at any time. However, CIANO Aquarium undertakes to apply the taxes, charges and prices indicated when the purchase order was placed.

In the event of a computer, manual, technical or any other error causing a substantial change not foreseen by CIANO Aquarium in the retail price, such that it proves to be exorbitant or manifestly derisory, the purchase order will be considered invalid and consequently canceled.

The prices and products available on www.ciano.pt are only valid for purchase orders placed via www.ciano.pt.

6. Purchase process

6.1 How to order

To order from www.ciano.pt, the User must have an e-mail account and their browser must be up to date and configured to accept cookies, in order to use all the navigability conditions of the www.ciano.pt online shop.

The photographs shown on www.ciano.pt are for illustrative purposes only, and the User should read the information on the product’s characteristics carefully and in full.

Placing an order at www.ciano.pt is quite simple:

  • Enter the Online Shop page;
  • Within the item you want, select the options and quantity you want;
  • Click on “Add” to add the items to your “Shopping Basket”. From then on, the item will be visible in your “Shopping Basket”;
  • At this point you can continue shopping by adding new products to the “Shopping Basket”. When you have selected all the items you want, select the “Cart” item at the top of the page;
  • To proceed, click on “Checkout”;
  • You can choose to make a purchase using your login (if you have already registered), create a new registration or make it as a guest without having to create an account;
  • Fill in the fields for “Billing details” and “Shipping details”. If you are a registered buyer, these details will be filled in automatically using your account details;
  • Select the desired payment method and then click on the “Finalize Order” button;
  • If you have chosen the PayPal payment option, you will be redirected to the PayPal website to make the payment;
  • You will receive an e-mail summarizing your order.

We suggest that you keep your order details for future reference.

CIANO Aquarium may not process orders in the following cases:

  • Whenever there is insufficient guarantee of proper collection;
  • Orders are incomplete or incorrect;
  • The products ordered are no longer available.

In these cases, CIANO Aquarium will inform you by e-mail of the reasons why the sales contract was not concluded.

If the products shown on www.ciano.pt are not available for dispatch within 15 days of receiving payment for the order, CIANO Aquarium will inform you of this unavailability and the deadline for dispatching the order, pending acceptance of the new delivery deadline. In the event of non-acceptance, CIANO Aquarium will refund the amount paid by the User.

6.2 Right not to accept the order or to cancel the purchase

CIANO Aquarium reserves the right to cancel any order, even if it has already been confirmed, in the following situations, without being liable for any damages or costs:

  • The product is no longer available (payments will be returned);
  • The billing information is not correct or verifiable;
  • The order is flagged by our Security Systems as an incorrect order or an order susceptible to fraud;
  • Payment is not received within 5 calendar days of accepting the order;
  • If there are indications that the buyer is under the age of 18 or does not have authorization from their legal representatives;
  • If there are indications that the buyer is not a final consumer;
  • If the price indicated in the Online Shop is found to be incorrect;
  • If the order cannot be delivered to the respective address;
  • If the purchase is made from a country that is not on the list of countries to be selected for delivery.

6.3 Undelivered orders

If the order cannot be delivered to the address provided by the User or to another location indicated by the User, for a reason attributable to the User, the inherent costs will be deducted from the amount of any refund to be made to the said User.

If the order is returned to CIANO Aquarium due to a fact attributable to the User, including non-payment of the additional fees or charges referred to in 6.6, the costs inherent to the return, namely transport, taxes, fees or any other expenses, will be deducted from the amount of any refund to be made to said User.

Shipping costs will not be refunded in the case of undelivered orders.

The cost of returning undelivered orders may also be subject to additional charges such as taxes, customs or other charges which will not be reimbursed by CIANO Aquarium.

6.4 Payment methods

CIANO Aquarium offers two solutions for paying for your order at www.ciano.pt:

  • Prior bank transfer;
  • PayPal.

6.5 Shipping costs 

Shipping costs will be added to the price of the item and apply to Belgium, France, Germany, Greece, Ireland, Italy, Luxembourg, the Netherlands, Portugal, Spain, Sweden and the United Kingdom.

Shipping costs do not include any import duties that may be levied upon entry into the User’s country of destination.

6.6 Customs duties, taxes and other charges

Customs duties, taxes and other additional charges inherent in the dispatch of items to non-EU countries are payable by the User and cannot be determined in advance.

6.7 Delivery times

Delivery time is 15 days after receipt of payment.

If the delivery time exceeds 15 days, CIANO Aquarium will contact the buyer to inform them of the time required, pending acceptance of the new delivery time. In the event of non-acceptance, CIANO Aquarium will refund the amount paid by the User.

7. General Conditions for all warranties

7.1 Warranty period

The guarantee for all products is valid for a statutory period of three (3) years from delivery of the product.

The buyer must report any non-compliance to CIANO Aquarium within two months from the date on which it was detected and always present the original invoice for the purchase of the product.

7.2 Procedure

CIANO Aquarium will examine the product in order to conclude whether the reported defect is covered by the guarantee.

In the event of a defect covered by the guarantee, CIANO Aquarium will repair or replace the product with an identical one, without prejudice to the other rights provided for in Decree-Law no. 84/2021, of 18 October.

In the repair or replacement situations referred to above, CIANO Aquarium will bear the necessary costs, including transport, labor and material costs, provided that the product is in a normally accessible condition.

7.3 Exceptions

The guarantee will not cover products that show defects caused by incorrect or inappropriate use, abnormal wear and tear, incorrect installation or assembly, alterations or cleaning with inappropriate methods or products, inclement weather, electrical discharges, negligence or accidents, moisture/liquid infiltration, use of non-original accessories, technical interventions by unauthorized personnel.

8. Returns and the right to withdraw from the contract

8.1 Right of withdrawal

The consumer has the right to freely withdraw from this contract within 14 calendar days, without having to state any reason.

The period for exercising the right of withdrawal expires 14 calendar days from the day on which you or a third party indicated by you, other than the carrier, acquires physical possession of the goods or, in the case of a contract where the consumer has ordered several goods in a single order and the goods are delivered separately, where you or a third party indicated by you, other than the carrier, acquires physical possession of the last good.

In order to exercise your right of withdrawal, you must notify us – CIANO Aquarium, S.A., with registered office at Rua de Revinhade, nº1055, 4650-376 Revinhade, Felgueiras, with telephone number +351 255 340 450 (Call to Portugal’s fixed network) and email info@ciano.pt – of your decision to withdraw from this contract by means of an unequivocal statement (e.g., letter sent by post or email).

You can use the model resolution form, but this is not compulsory.

You also have the option of completing and submitting the model withdrawal form or any other unequivocal declaration of withdrawal electronically via our website www.ciano.pt. If you make use of this option, we will send you an acknowledgment of receipt of the cancellation request on a durable medium (e.g. by e-mail) without delay.

In order for the withdrawal period to be respected, it is sufficient for your communication regarding the exercise of the right of withdrawal to be sent before the expiry of the withdrawal period.

To do this, the item must be in the same condition as it was sold, in its original packaging and accompanied by all the accessories that make it up. Please contact our after-sales service on +351 255 340 450 (Call Portugal landline) for more information on shipping procedures.

Note: never send the item to CIANO Aquarium without first contacting the after-sales service.

8.2 Return conditions in the event of free cancellation of the contract

  • Articles without signs of misuse, and whose handling in no case exceeds that which is normally permitted in a commercial establishment under the terms and for the purposes of no. 3 of article 13 and no. 2 of article 14 of Decree-Law 24/2014 of 14 February;
  • Return of the complete item, with all its components and accessories, instruction manual and original packaging in perfect condition;
  • Return deadline: The consumer must return the goods no later than 14 (fourteen) days from the date on which they informed CIANO Aquarium of the decision to terminate the contract, and must bear the direct costs of returning the goods. The deadline is deemed to have been met if you return the goods before the expiry of the 14-day period.

Refunds: In the event of a return, reimbursement of the value of your purchase, including delivery costs (with the exception of additional costs resulting from your choice of a shipping method other than the least expensive standard shipping method offered by us), will be made without undue delay and , in any event, no later than 14 days from the date on which CIANO Aquarium was informed of your decision to withdraw from the contract, via the same means of payment that you used for the initial transaction, and at no cost to the consumer, after validation of fulfilment of the return conditions described above.

We may withhold the refund until we have received the returned goods, or until you provide proof of dispatch of the goods, whichever comes first.

The following contracts are excluded from the consumer’s right to freely withdraw from the contract:

  • Supply of goods made to the consumer’s specifications or manifestly personalized;
  • Supply of goods which, by their nature, cannot be reshipped or are liable to deteriorate or quickly become out of date;
  • Supply of sealed goods that cannot be returned for reasons of health protection or hygiene when opened after delivery;
  • Supply of goods which, after delivery and by their nature, are inseparably mixed with other products.

10. Responsibility 

The website user is responsible for the content of the information sent or transmitted.

CIANO Aquarium is not responsible for any damage resulting from any computer virus or any other situation to which it is unaware and which prevents access to and correct operation of the domain www.cianoaquarium.pt or www.ciano.pt or www.cianoaquarium.com as well as the services made available on it.

11. Applicable law

These general conditions and all contracts that may be entered into under them are governed by Portuguese law.

Privacy Policy

It is a concern of CIANO Aquarium, S.A., hereinafter referred to as CIANO, to allow candidates access to transparent information on how we process their personal data.

1. The company CIANO Aquarium, S.A., NIPC 501 828 699, headquartered at Rua de Revinhade, 1055, in the parish of Revinhade, in the municipality of Felgueiras (4650-376), is the entity responsible for the treatment of its customers. personal data.

2. Personal data may be collected and processed by CIANO for the following purposes:

  • Execution of a contract, namely for the purchase and sale of goods, repair services and delivery services;
  • Administrative management within the scope of the execution of a contract;
  • Compliance with the various legal obligations to which CIANO is bound, namely, invoicing;

4. The personal data entrusted to CIANO will be kept only for the period deemed necessary for the pursuit or completion of the purposes of the processing for which they are intended, in compliance with the maximum deadlines necessary to comply with contractual, legal, or regulatory obligations.

Thus, CIANO will keep the personal data collected for a period of 20 years after the end of the contractual relationship entered into, except when compliance with legal or regulatory obligations is imposed (for example, billing or administrative management documents must be kept for the period 10 years.

However, if personal data are used for multiple purposes, the longer term must be considered.

At the end of the conservation period, Ciano will proceed with the elimination of said personal data.

5. Personal data transmitted to CIANO will be recipients, namely:

  • Employees authorized by the company, bound by the duty of secrecy and confidentiality;
  • The entities to which the data must be communicated pursuant to a contract, legal provision, or at the request of the data subject;
  • Financial institutions that manage the entity’s accounts for any reimbursements to be made;
  • The intermediaries and insurance companies with whom the insurance contract was concluded;
  • Inspection entities.

6. CIANO has implemented adequate and effective technical and organizational measures in order to guarantee the integrity of its customer’s personal data, namely through material and technological means that allow their knowledge, storage, use, transmission, and destruction. Guarantee that extends to the company’s service providers, strictly selected and who are required to comply with the legal and regulatory obligations to which they are attached, as well as the guidelines transmitted by the latter with regard to data processing.

7. The data subject has the right, at any time, to access, rectify as well as, within the limits of the law, to oppose, limit or delete their personal data with the company, responsible for the processing here, as well as the request its portability, which can be done by sending a communication to the email address privacy.ciano@gmail.com, proving your identity and indicating what right you wish to exercise, by sending a letter to the company’s address above, to the attention of the Data Protection Department or by personal request at the company’s headquarters.
